Statutory Rape

At the risk of inciting a riot I’m going to pose a question.  Forget any details about how the specific laws are written and obviously assume the sex was consensual.  Ok here it is:

A high school senior has sex with a high school freshman.  Word gets out.  Senior gets charged with a crime that has the word “rape” attached to it because senior happens to be 18 instead of 17, the age of the half the people in senior’s own class.  Senior gets convincted, potentially goes to jail for a while, gets in a shitload of trouble, is now a sex offender, etc, etc.  Am I the only one that sees something terribly wrong with this?
